Founders, two audiences

Start here if you already read Musk/Altman and want the Valley register.

Peer-to-peer speech is often the honest register; employee, press, and Congress speech is the affordable one. Five pairs.

Read full-screen
  1. Step 1 of 5

The launch post and the compensation sentence are the same week, different audiences.

    Tech belongs to the world

    mission split

    Public

    OpenAI · 2015-12-11

    launch blog, December 2015

    openai.com announcement

OpenAI is a non-profit artificial intelligence research company. Our goal is to advance digital intelligence in the way that is most likely to benefit humanity as a whole, unconstrained by a need to generate financial return.

    Private

Sam Altman, founding correspondence · 2015

    organizer, email

Emails later filed in Musk v. Altman

The same founding thread holds both “tech belongs to the world” and the need for startup-like compensation if the project works.

Both sentences are in the founding pile. The blog kept one. The cap table kept the other. Mission-split is not a later fall. It is two audiences on day one.

The tell · Read the launch post next to the compensation sentence. The company is the space between them.

How this became public: Musk v. Altman exhibits; Business Insider founding-mail story.

  2. Step 2 of 5

Later the argument is about boards. That is the honest register. Now an older Valley version of founder-to-founder speech:

    Texts about control

    mission split

    Public

    OpenAI · 2015-2023

    governance story

    Charter and blog posts

The charter says the mission comes first — even over OpenAI itself becoming a subsidiary of another project if that is what it takes.

    Docket 4:24-cv-04722

    Private

Elon Musk and Sam Altman · circa 2017-2018

    founders, texts and mail

    Musk v. Altman productions

The later texts and mail are about control: who sits on the board, who can fire whom, and whether a nonprofit wrapper can hold a company that now has a cap table.

Charter language is written for the world. Control language is written for the other founder. Both are real. Only one was on the homepage.

The tell · When the fight is about boards and not about papers, you are in the honest register.

How this became public: Musk v. Altman, N.D. Cal. 4:24-cv-04722; OpenMail / Visual Inbox.

  3. Step 3 of 5

Jobs and Schmidt do not need a blog. They need a smiley. Next, the buy-versus-compete sentence:

    The smiley

    paper trail

    Public

    Valley CEOs · 2007

    public friendship and rivalry

    Keynotes and press

In public, Jobs and Schmidt performed rivalry plus mutual respect — two companies racing to hire the same kind of person.

    Private

    Steve Jobs · 2007

    Apple CEO

Email to Eric Schmidt after the recruiter was handled

    :)

    Docket 5:11-cv-02509

A smiley is not a joke here. It is a receipt. The private market cleared. The public market kept its posters.

The tell · The shortest email in the file is often the preference.

How this became public: High-Tech Employee Antitrust Litigation docket.

  4. Step 4 of 5

Zuckerberg’s email is the labor and product-market policy. Press-Zuck is a different person. Last, a founder whose public machine never existed:

We can likely always just buy

    paper trail

    Public

    Mark Zuckerberg / Facebook · 2010s

    public competition story

    Press and later antitrust testimony

Public Facebook described a fiercely competitive market in which users could leave at any time and rivals were a click away.

    Private

    Mark Zuckerberg · 2008

    CEO, internal email

    House Judiciary 2020 production

It is better to buy than compete. We can likely always just buy any competitive startups.

The public market is exit. The private market is acquisition. Instagram later became the worked example.

The tell · If the founder writes “buy rather than compete,” believe the email, not the concentration speech.

How this became public: House Judiciary Committee antitrust document dump, 2020.

  5. Step 5 of 5

Peer-to-peer speech is often the honest register; employee, press, and Congress speech is the affordable one.

    A tiny drop of blood

    testimony gap

    Public

    Elizabeth Holmes · 2013-2015

    Theranos CEO, press and investors

    WSJ magazine, TEDMED, investor pitch

Theranos can run a full range of laboratory tests from a tiny drop of blood — a prick of the finger instead of a vial from the arm.

    Private

Elizabeth Holmes and Sunny Balwani · 2014-2015

    CEO and COO, private texts

    Text messages entered at trial

The texts show money stress, demo anxiety, and control of who may speak — not a working finger-stick Edison for the menu they were selling.

The drop of blood is a public machine. The phone is a private one. Preference falsification here is not a euphemism. It is a product that exists in one register only.

The tell · If the demo and the menu cannot be in the same room, believe the room you are not invited into.

How this became public: Criminal trial exhibits, N.D. Cal.; press copies of texts.
